REACh – a brief overview
In October 2003, a draft concerning new chemical regulations was introduced on a European basis. After various revisions and adjustments, REACh was agreed upon by the environment council on 18.12.2006 and came into effect on 01.06.2007. With the introduction of REACh, the EU is pursuing its aim to ensure that trading in chemical subtances is made as safe as possible. In order to guarantee this safety, manufacturers, importers and end-users must ensure that only those substances are manufactured, applied or distributed that neither endanger human health nor excessively pollute the environment. Should such substances be produced or imported in amounts exceeding one tonne per year, these must be registered. Without such a registration, the sale or usage is forbidden. Who is affected by REACh? The obligation to register exists principally for the “traffickers”, namely manufacturers or importers of such substances. Should companies purchase such substances in the European market, they will be referred to as “end-users”. REACh follows the motto „No data, no market“. Accordingly, only substances can enter the market which have the adequate documentation concerning the type, scope and, in particular, the relevant product volumes. Should more than one tonne of a certain substance be produced or imported into the EU per year, the registration according to REACh is necessary.
The Manufacturers and Importers
The responsibility for the control of chemical safety is transferred as part of a reversal of burden of proof from national authorities to the respective manufacturers and importers. Included in this reversal, manufacturers and importers will, in the future, have to prove that their products are safe to use and will not excessively pollute the environment nor endanger health. These regulations are primarily aimed at manufacturers and importers, however, the end-user is also obliged to register should they synthesise or import substances themselves in addition to those purchased.

The idea for the E-learning project was developed by a consortium made up of the German consulting company Ökopol GmbH, the Danish partner company HSE consult and DHI water & environment. The Danish environment authority EPA funded the initial development. The German Ministry of Environment funded the further development of content and, in particular, the development of the German version adapted to meet the needs of small and medium-sized enterprises.

As a nationwide information point, the REACh-Helpdesk offers, on various platforms, information and orientation help with the implementation of REACh and should support manufacturers, importers and users of chemical substances in registering, evaluating and licensing issues.
